Chủ trương sử dụng nguồn mở cũng đã được khẳng định trong các văn bản như Nghị quyết 36 của BCT, Nghị quyết 26 của Chính phủ.
Sửa đổi Luật CNTT năm 2006 để đón nhận xu thế phát triển mới của cách mạng cong nghệ 4.0 và nền kinh tế số, điều chỉnh các bất cập trong hoạt động ứng dụng CNTT và phát triển công nghiệp CNTT, hướng tới mục tiêu phát triển mạnh công nghiệp CNTT, tăng cường ứng dụng CNTT trong tổ chức, doanh nghiệp, tăng năng lực cạnh tranh của các doanh nghiệp Việt nam trong xu thế chuyển đổi số.
Xây dựng bộ đính mức triển khai áp dụng phần mềm nguồn mở: dự kiến sẽ được hoàn thành trong năm 2017 và ban hành trong năm 2018. Bộ định mức này bao gồm định mức triển khai của gần 20 loại sản phẩm phần mềm nguồn mở ban hành theo Thông tư 20/2014/TT-BTTTT.
Nghiên cứu các quy định quốc tế về phần mềm nguồn mở, chuẩn mở, dữ liệu mở để đưa vào hệ thống văn bản pháp lý về CNTT trong quá trình sửa đổi Luật CNTT.
